These terms and conditions (“Terms”, “Agreement”) are an agreement between Smiley Geeks (“Smiley Geeks”, “us”, “we” or “our”) and you (“User”, “you” or “your”). This Agreement sets forth the general terms & conditions of your use of the smileygeeks.com website, app and any of its products or services (collectively, “Website”, “app” or “Services”). By accessing the website at https://www.smileygeeks.com, you are agreeing to be bound by these terms of service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this website are protected by applicable copyright and trademark law.
Accounts and membership (Including Monthly IT Help)
The materials on Smiley Geeks website are provided on an ‘as is’ basis. Smiley Geeks makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
Further, Smiley Geeks does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.
Service Level Agreement (SLA)
Whilst Smiley Geeks aim to provide the best service, in times of busy periods it may take longer to answer support queries. We aim to always answer within 1 business day during UK traditional working hours of 9am – 5pm. In the unlikely event we for any reason are unable to do this, we will inform you so we are able to make alternative arrangements.
By signing up to become a monthly member of this service provided by Smiley Geeks, you agree to pay the agreed price each month unless you contact us in writing to provide 1 month’s notice of cancellation of services. Smiley Geeks reserve the right to cancel providing services to you at any time, and in the event of our cancellation we will not charge you the 1 month notice fee.
Limitation of Liability
To the fullest extent permitted by applicable law, in no event will TowerWatch Academy, its affiliates, officers, directors, employees, agents, suppliers or licensors be liable to any person for (a): any indirect, incidental, special, punitive, cover or consequential damages (including, without limitation, damages for lost profits, revenue, sales, goodwill, use or content, impact on business, business interruption, loss of anticipated savings, loss of business opportunity) however caused, under any theory of liability, including, without limitation, contract, tort, warranty, breach of statutory duty, negligence or otherwise, even if Smiley Geeks has been advised as to the possibility of such damages or could have foreseen such damages.
Whilst we will do everything we can to resolve your support issue, Smiley Geeks cannot be held responsible for damage or computer malfunction on devices that we did not install, setup, or manage from the beginning of its lifetime.
“The company” makes no warranty, expressed or implied, as to the results obtained from the use of the information on the website advice given to you in the membership forum or via email. “The company” shall have no liability for the accuracy of the information and cannot be held liable for any third-party claims or losses of any damages. The user shall have the right to view the information and usage for the purpose for which it is intended and disclosed. The information contained in this website does not constitute a confirmed offer to sell or the solicitation of an offer to buy any product or service; and should not be relied upon in connection with any investment decision.
Changes and Amendments
We reserve the right to modify this Agreement or its policies relating to the Website, membership or Services at any time, effective upon posting of an updated version of this Agreement on the Website. When we do, we will revise the updated date at the bottom of this page. Continued use of the Website, app after any such changes shall constitute your consent to such changes. “The company” may, at any time, revise the information on this web site without notice and makes no commitment to update this information.”

These terms and conditions are governed by and construed in accordance with the laws of the United Kingdon and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location.
